FLSA - Failure to Pay Overtime

The Fair Labor Standards Act (“FLSA”) states that if an employee works more than 40 hours in a workweek, their employer is required to pay premium pay (time and a half) for all time worked over 40 hours. The overtime laws apply to nearly every Texas employer and are strictly enforced by the courts, although there are a few exceptions for white collar employees and certain professional and administrative employees.

Erxleben and Michael B. Shapiro; In the District Court of Jefferson County, Texas; 136th Judicial District. Lead counsel in consumer fraud litigation.
